When a licence is suspended you are given the reasons and a period in which to respond. During suspension you cannot assign new certificates of sponsorship, though workers you already sponsor keep their permission while the matter is considered.

The response is not an appeal and not a negotiation. It is an evidenced answer to specific allegations, and the difference between a suspension lifted and a licence revoked is very often the quality of that answer.

Representations that argue rather than evidence tend to fail. So do responses that concede too readily, or that address the allegation the organisation wishes had been made rather than the one that was.

How organisations damage their own position

Responding without understanding the allegation

A response to the wrong point is worse than a late one. The grounds have to be read precisely.

Assertion without evidence

Statements about how the organisation operates carry little weight unless the documents show it.

Inconsistency with what was said at the visit

Representations that contradict interview answers create a new problem alongside the original one.

Missing the deadline

The period is not generous and is not routinely extended. Work has to start immediately.

Continuing as though nothing has changed

Attempting to sponsor during suspension, or failing to manage the position with existing workers, compounds matters.

Suspension is a serious position, but it is not the end of the matter.

A suspension means the Home Office has concerns it considers serious enough to stop your sponsorship while it investigates. It does not mean the outcome is settled. Organisations that respond properly and promptly, with evidence, are frequently able to keep their licence, sometimes with an action plan attached.

The other conversation to have early is with your sponsored workers. They will hear something, and a considered explanation from the employer is better than speculation.

What happens if my sponsor licence is suspended?

Can we still employ our sponsored workers?

Existing sponsored workers generally continue in employment during a suspension, and your duties towards them continue. What stops is new sponsorship.

How long does a suspension last?

As long as the Home Office needs to consider the matter, which varies with its complexity and with how complete your response is. A thorough, evidenced response tends to shorten it.

Should we respond ourselves?

You can, but this is the point at which advice earns its cost. The representations are the main opportunity to influence the outcome, and there is no second attempt.
