Partner/Spouse

Partner Visas (Family)

These visas are for the partners of people who are UK citizens or permanent residents, or with refugee status.

Basic rules overview

There are three categories:

  • Partner (married or in a civil partnership).

  • Partner (unmarried or same-sex relationship).

  • Fiance(e) or proposed civil partner.

The documents required are different for each category, but in all cases:

  • The relationship must be genuine.

  • There are certain financial and accommodation requirements.

  • Must reach a minimum Standard in the English language

Extension of this visa


Fiance(e) visas are valid for 6 months. Once the relationship has been formalised through marriage or civil partnership, the applicant can switch to a Partner visa. Partner visas are valid for 30 months, which can then be extended for another 30 months. After this, the applicant will be eligible to apply for Indefinite Leave to Remain.

Family Visas

Parent

Parent Visa (Family Visa)

You can apply to live in the UK to care for your child. To be eligible for this visa, your child must either be under 18 years old on the date you apply, must not live an independent life or must have been under 18 years old when you were first granted Leave.

Basic rules overview

Your child must be living in the UK and one of the following must be true:

  • They’re a British or Irish citizen.

  • They’ve settled in the UK - for example, they have indefinite leave to remain, settled status or proof of permanent residence.

  • They’re from the EU, Switzerland, Norway, Iceland or Liechtenstein and have pre-settled status - they must have started living in the UK before 1 January 2021.

  • if you’re applying in the UK, they must have lived in the UK for 7 years continuously and it would not be reasonable for them to leave.

Extension of this visa

This visa can be extended to permanent residency if you have lived in the UK for 5 years continuously on a family visa as a parent. Time spent on any other visa will not be included in your 5 years calculation.

Child Visa (Family Visa)

You can apply for a family visa to join your parent in the UK.

Basic rules overview

Application to this visa can be made with your parent as their dependent or separately, as long as you know what permission to stay your parent has. You’ll get the same permission to stay as your parent if you were born in the UK. You can either:


Be added to your parent’s next application as a dependant.

Apply separately.

  • To apply separately, you’ll need to know what kind of permission to stay in the UK (Limited leave to remain) your parent has

  • You may not need a family visa if at least one of your parents has indefinite leave to remain or proof of permanent residence..

  • If your parents cannot include you in their form and you’re in the UK, you may be eligible to apply for Private Life in the UK.

  • If your parents have settled or pre-settled status under the EU Settlement Scheme you may be able to apply to the free EU Settlement Scheme.

Extension of this visa

Your stay will be unlimited if your family member is British, Irish or settled in the UK, and you will not need to extend or settle. However, in other cases, you will be able to extend your visa while in the UK and this will lead to indefinite leave to remain.

Adult Dependent Relative Visa

Adult Dependent Relative Visa (Family Visa)

Basic rules overview

To apply as an Adult Relative, you must prove the following:

  • You are 18 years old and above.

  • You need long-term care to do every day personal and household tasks due to illness, disability, or your age.

  • That the care you need is not affordable or available in the country you live in.

  • That the person you will be joining in the UK will accommodate, support and care for you without claiming public funds for at least 5 years.

Extension of this visa

Your stay is unlimited if your family member is British, Irish or settled in the UK, and you will not need to extend or settle

If your family member has refugee status or humanitarian protection in the UK, you can stay as long as your family member stays.
You’ll need to apply to extend or settle when they do.
